Terms of Service

These terms apply to every offer, order and agreement between ItsDCS and a client or customer, unless something different has been agreed in writing.

2. Prices and payment

All prices shown on itsdcs.co include VAT for customers in the European Union. Prices for photography services are quoted per project and confirmed in writing before a booking is final.

Accepted payment methods are shown at checkout and currently include Wero, SEPA and major debit and credit cards. Payments are processed by Squarespace Payments, Stripe and PayPal. ItsDCS does not see or store your card or bank details.

Invoices for photography services are due within 14 days of the invoice date, unless another term is agreed in writing.

3. Digital products

Digital products such as Lightroom preset packs, wallpaper packs and guides are delivered as downloadable files.

After payment is confirmed, a download link is sent to the email address given at checkout. The link stays valid for 7 days and allows 1 download per person. If the link expires or fails before you have been able to download your files, email info@itsdcs.co and a new one will be issued at no cost.

Digital products are for use by the buyer only. They may not be resold, shared, redistributed, bundled, or offered for download anywhere else. Presets may be used freely on your own photos, including commercially, but the preset files themselves remain the property of ItsDCS.

Digital products are supplied as they are. Compatibility requirements are listed on each product page. Presets are made for Lightroom Classic and are supplied without masks. Because every photo is different, results will vary depending on your camera, lighting and exposure, and adjustment after applying a preset is normal.

4. Right of withdrawal for digital products

As a consumer you would normally have 14 days to withdraw from an online purchase. For digital content that is delivered immediately, this right does not apply once delivery has started, provided you have expressly agreed to immediate delivery and acknowledged that you lose your right of withdrawal.

By completing a purchase of a digital product on itsdcs.co, you expressly request immediate delivery and confirm that you understand you give up your right of withdrawal as soon as the download becomes available.

This does not affect your legal rights if a product is faulty, does not match its description, or cannot be downloaded. In those cases contact info@itsdcs.co and the issue will be fixed or the purchase refunded.

5. Photography services

Bookings. A booking is confirmed once the date, location and scope have been agreed in writing and, where applicable, the deposit has been received.

Deposit. A deposit of 50% is required to reserve a date. The remaining balance is due after the last shoot.

Cancellation by the client. Cancellations made more than 14 days before the shoot are free of charge and the deposit is refunded. Cancellations after that point mean the deposit is retained to cover the reserved time.

Rescheduling. Weather dependent shoots may be moved to a new date at no cost when conditions make the planned shoot unworkable. A new date is agreed in consultation.

Travel. Travel costs are listed on the services page and are added to the quote when they apply.

Delivery. Edited images are delivered within 14 days after the last shoot, unless another term is agreed. The selection of which images are edited, and the editing style applied, are made by ItsDCS as part of its creative work.

Raw files. Unedited and raw files are not part of the delivery and are not supplied.

6. Intellectual property and licensing

All photographs, videos, presets, guides and other material created by ItsDCS remain the intellectual property of ItsDCS. Copyright is never transferred by default.

Clients receive a licence to use the delivered images. What that licence covers, for example personal use or commercial use, is set out in the quote and on the licensing section of the site. Any use beyond the agreed licence requires written permission and may involve an additional fee.

Credit is appreciated wherever images are published, and is required where the agreed licence states it.

Unless agreed otherwise in writing, ItsDCS may use delivered work for its own portfolio, website and social media.

7. Liability

ItsDCS carries out every assignment to the best of its professional ability. Liability is limited to the amount invoiced for the assignment in question, and in every case to the amount covered by its insurance where insurance applies.

ItsDCS is not liable for indirect losses, including loss of profit, missed opportunities or consequential damage. ItsDCS is not liable for delays or cancellations caused by circumstances beyond its reasonable control, such as extreme weather, illness, accidents, or equipment failure beyond repair, though in those cases a new date or a refund will always be offered.

8. Complaints

If you are not satisfied, email info@itsdcs.co with a clear description of the problem within 14 days of delivery. Every complaint receives a response within 14 days.

Consumers in the European Union may also submit a dispute through the European Commission online dispute resolution platform.

9. Applicable law

Dutch law applies to all agreements with ItsDCS. Disputes are submitted to the competent court in the Netherlands, unless the law requires otherwise.

10. Changes

These terms may be updated. The version published on itsdcs.co at the moment an order is placed is the version that applies to that order.
