ItsDCS is the controller of the personal data described below.
What data is collected and why
Contact and booking enquiries. When you use the contact form or email directly, your name, email address, phone number if you provide one, and the content of your message are collected. This data is used to answer your enquiry and, if it leads to a booking, to plan and carry out the shoot. Legal basis: performance of a contract, or legitimate interest in responding to enquiries.
Store orders. When you buy a digital product, the following is collected: name, email address, billing address, country, the products ordered, the amount paid and the payment method. Card numbers and bank details are never seen or stored by ItsDCS. They are handled directly by the payment providers. Legal basis: performance of a contract and legal obligation.
Tax records. Invoices and order records are kept because Dutch tax law requires it. Legal basis: legal obligation.
Newsletter and marketing. If you sign up for updates, your name and email address are used to send them. You can unsubscribe at any time using the link in every message. Legal basis: consent.
Website statistics. Visitor data such as pages viewed, approximate location, device type and referring website is collected to understand how the site is used. Legal basis: consent for cookies that are not strictly necessary, legitimate interest for basic aggregated statistics.
Who processes your data
ItsDCS uses the following service providers, who process data on its behalf under processing agreements:
Squarespace, which hosts the website, the store and the contact form
Squarespace Payments and Stripe, which process card and bank payments
PayPal, if you choose PayPal at checkout
Some of these providers are based outside the European Economic Area. Where that is the case, transfers are covered by Standard Contractual Clauses or an equivalent legal safeguard.
Your data is never sold, rented or shared with third parties for their own marketing purposes.
How long data is kept
Enquiries that do not lead to a booking: up to 12 months
Client and booking records: up to 5 years after the final invoice
Invoices and order records: 5 years, as required by Dutch tax law
Newsletter subscriptions: until you unsubscribe
Website statistics: in line with the retention period of the tool used, normally up to 26 months
Photographs of people
If people appear recognisably in photographs taken during a commissioned shoot, those images are personal data. Images are used for delivery to the client and, unless agreed otherwise in writing, for portfolio and social media purposes. If you appear in an image and want it removed from public channels, email info@itsdcs.co and it will be taken down.
Cookies
The site uses cookies that are strictly necessary for it to function, for example to keep your shopping cart working and to remember your cookie preferences. These do not require consent.
Cookies used for statistics and marketing are only placed after you accept them in the cookie banner. You can change or withdraw your choice at any time through the banner or by clearing the cookies in your browser.
Your rights
Under the AVG you have the right to:
ask what personal data is held about you and receive a copy
have inaccurate data corrected
have your data deleted, where there is no legal obligation to keep it
restrict or object to the processing of your data
receive your data in a portable format
withdraw consent at any time, where processing is based on consent
To use any of these rights, email info@itsdcs.co. A response follows within one month.
If you believe your data is being handled incorrectly, you can file a complaint with the Dutch data protection authority, the Autoriteit Persoonsgegevens, at autoriteitpersoonsgegevens.nl.
Security
Reasonable technical and organisational measures are in place to protect your data, including encrypted connections across the whole site and access controls on stored files. If a data breach occurs that is likely to affect your rights, you will be informed without undue delay.
